WanMerch LLC ("Wanload," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our freight marketplace platform.

By using our Service, you consent to the data practices described in this policy.

IMPORTANT: WANLOAD IS A TECHNOLOGY PLATFORM ONLY. WE PROVIDE A MARKETPLACE THAT CONNECTS SHIPPERS AND CARRIERS BUT DO NOT PROVIDE TRANSPORTATION SERVICES.

The information you share with other users through our platform (such as contact details, company information, and load details) is shared at your own risk. Wanload is not responsible for how other users may use, store, or disclose information you share with them.

2. Information We Collect

Personal Information

We collect information you provide directly, including:

  • Name and email address
  • Company name and business address
  • MC (Motor Carrier) and DOT numbers
  • Insurance certificates and documentation
  • Payment information (processed securely by Stripe)
  • Profile photos and signatures
  • Phone number and contact preferences

Automatically Collected Information

  • Device information (type, operating system, unique identifiers)
  • IP address and browser type
  • GPS location data (for tracking and load matching)
  • Usage patterns and app interactions
  • Cookies and similar tracking technologies

Essential cookies cannot be disabled as they are required for the platform to function.

We do not use advertising or marketing cookies.

Third-Party Sources

We may receive information from FMCSA for carrier verification, credit bureaus for payment processing, and identity verification services.

Driver-Specific Data

For carriers and drivers, we may also collect:

  • Commercial Driver's License (CDL) information
  • Hours of Service (HOS) logs
  • Vehicle identification and inspection records

This information may be shared with shippers as part of the carrier verification process.

Driver data is retained for a minimum of 3 years per FMCSA regulations.

3. Platform Fee Payment Data

Wanload charges a 3% platform fee to shippers upon successful delivery confirmation. To process this fee, we collect and process payment information through our payment processor, Stripe.

Shipper Payment Information

To process the platform fee, we collect:

  • Credit or debit card information (card number, expiration, CVV)
  • Bank account information for ACH transfers (account number, routing number)
  • Billing name and address

Important: All payment card and bank account data is processed and stored exclusively by Stripe. Wanload never stores full card numbers, CVVs, or bank account numbers on our servers. We only receive tokenized references to your payment methods.

Transaction Records

For platform fee transactions, we maintain records of:

  • Load details and agreed rates
  • Platform fee amounts charged
  • Payment status and dates

Payment Data Retention

Payment transaction records are retained for a minimum of 7 years to comply with financial regulations and tax requirements.

Stripe billing events are retained for 7 years for financial compliance.

Webhook event logs are retained for 90 days for debugging and reconciliation purposes.

Direct Payments Between Parties

Wanload does not collect, process, or have visibility into payment arrangements made directly between shippers and carriers for freight services. All freight payments are handled directly between the parties outside of the Wanload platform.

Security and Compliance

All payment processing is handled by Stripe, which is PCI-DSS Level 1 certified—the highest level of payment card industry security compliance. Your financial data is encrypted using industry-standard TLS/SSL encryption during transmission and AES-256 encryption at rest.

4. How We Use Your Information

We use your information to:

  • Facilitate load matching between shippers and carriers
  • Verify carrier credentials and insurance status
  • Process payments and manage transactions
  • Provide real-time shipment tracking
  • Enable communication between platform users
  • Detect and prevent fraud, abuse, and security threats
  • Comply with legal and regulatory requirements
  • Improve our services and user experience
  • Send service-related notifications and updates

5. Information Sharing and Disclosure

IMPORTANT: WHEN YOU USE OUR PLATFORM, YOU MAY SHARE INFORMATION DIRECTLY WITH OTHER USERS. THIS SHARING IS AT YOUR OWN RISK AND DISCRETION.

Other Platform Users

When you post loads or place bids, relevant information (company name, MC#, contact info) is shared with counterparties to facilitate transactions. You acknowledge that:

  • Wanload has no control over how other users use your information
  • Other users may contact you outside of our platform
  • You are responsible for evaluating the trustworthiness of other users
  • Wanload is not liable for any misuse of your information by other users

Service Providers

We work with third-party providers for payment processing (Stripe), cloud hosting, analytics, and customer support. These providers are contractually obligated to protect your information.

Legal Requirements

We may disclose information when required by law, court order, or government request, or to protect our rights, safety, or the safety of others.

6. Third-Party Verification Services

We may display information obtained from third-party sources, including:

  • FMCSA SAFER data for carrier verification
  • Insurance certificate verification services
  • Identity verification providers

USERS SHOULD INDEPENDENTLY VERIFY ALL CARRIER CREDENTIALS, INSURANCE STATUS, AND OTHER IMPORTANT INFORMATION BEFORE ENTERING INTO ANY AGREEMENT.

7. Data Retention

We retain your information for as long as your account is active or as needed to provide services. Per FMCSA regulations, we retain transaction records for a minimum of 3 years.

After account deletion, we may retain certain data for legal compliance, fraud prevention, and dispute resolution purposes.

8. Data Security

We implement industry-standard security measures including:

  • Encryption of data in transit and at rest
  • Secure payment processing through Stripe
  • Regular security assessments and audits
  • Access controls and authentication requirements
  • Employee training on data protection

WHILE WE STRIVE TO PROTECT YOUR INFORMATION, NO METHOD OF TRANSMISSION OVER THE INTERNET OR ELECTRONIC STORAGE IS 100% SECURE. YOU USE THE SERVICE AND TRANSMIT INFORMATION AT YOUR OWN RISK. WANLOAD IS NOT LIABLE FOR ANY UNAUTHORIZED ACCESS, HACKING, DATA LOSS, OR OTHER BREACHES THAT MAY OCCUR DESPITE OUR REASONABLE SECURITY MEASURES.

We strongly encourage you to:

  • Use strong, unique passwords for your account
  • Enable two-factor authentication when available
  • Never share your login credentials
  • Log out of your account on shared devices
  • Report any suspicious activity immediately

9. Your Rights and Choices

You have the right to:

  • Access: Request a copy of your personal data
  • Correction: Update or correct inaccurate information
  • Deletion: Request deletion of your account and data
  • Opt-out: Unsubscribe from marketing communications
  • Data Portability: Receive your data in a portable format
  • Location Services: Disable GPS tracking in device settings

Data Retention Schedule

We retain different categories of personal information for the following periods:

  • Identifiers: Retained for the duration of your account plus 3 years
  • Commercial Information: Retained for 7 years for financial compliance
  • Professional Information: Retained for 3 years per FMCSA regulations
  • Geolocation Data: Retained for 90 days after trip completion
  • Internet Activity: Retained for 12 months
  • Inferences: Retained for the duration of your account

Sensitive Personal Information

We collect and use the following sensitive personal information:

  • Precise geolocation data (GPS tracking for load delivery)
  • Financial information (payment cards and bank accounts via Stripe)

Note: Limiting sensitive data processing may restrict your ability to use certain platform features such as load tracking.

Do Not Track

Our platform does not currently respond to browser Do Not Track (DNT) signals as there is no industry standard for DNT compliance. However, you can opt-out of analytics tracking by contacting us.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. We will not deny you services, charge different prices, or provide a different level of service based on your exercise of privacy rights.

We do not sell personal information. We do not use or disclose sensitive personal information for purposes other than those permitted under California law.

11. Limitation of Liability for Data

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WANLOAD SHALL NOT BE LIABLE FOR:

  • Any unauthorized access to or disclosure of your personal information
  • Any loss, misuse, or theft of your data by third parties
  • Any data breaches caused by third-party service providers
  • Any damages resulting from your sharing of information with other users
  • Any inaccuracies in third-party verification data (FMCSA, insurance, etc.)
  • Any failure to protect your own account credentials

You acknowledge that you share information on the platform at your own risk and agree to hold Wanload harmless from any claims related to data privacy issues arising from your use of the Service.

12. Children's Privacy

Our Service is not intended for users under 18 years of age. We do not knowingly collect personal information from children. If we learn we have collected information from a child, we will delete it promptly.

13. International Data Transfers

Your information may be transferred to and processed in the United States or other countries where our servers are located. By using our Service, you consent to such transfers. We will take appropriate measures to protect your information in accordance with this Privacy Policy.

14. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the updated policy.
